Scotland: Scottish Government announces the introduction of a Declaration of Compliance of Terms of Service

A notification has been sent to dentists and dental bodies corporate providing NHS dental services, that Scottish Ministers intend to introduce a Declaration of Compliance of Terms of Service

The Scottish Government has announced their intention to introduce a Declaration of Compliance of Terms of Service. PCA(D)(2026)1 also highlights some obligations from the Terms of Service which Scottish Government feel are key in supporting patient care and access to NHS dental services.

It sets out their intention to bring forward a process around compliance, with new applicants to a dental list and existing entrants required to complete a Declaration of Compliance every three years. These new arrangements will be introduced in 2026-7 and further information will be shared in due course.

Next steps

We recommend that dentists familiarise themselves with the information outlined in this PCA, which includes sections on Terms of Service and a reminder of key obligations for dentists and dental bodies corporate providing NHS dental services.

Scottish Government officials will be working closely with us, as these new arrangements relating to a Declaration of Compliance are developed.
