Adoption leave and pay provide important support for employees who are welcoming a child through adoption or a surrogacy arrangement. These statutory rights give eligible employees time away from work and financial assistance while they form a stable and secure family environment for their child. As an employer, you must understand the eligibility rules, the notice requirements and the legal protections that apply to adoptive parents throughout the adoption process and during their period of leave.

Employees adopting a child through an approved agency may qualify for statutory adoption leave and statutory adoption pay (SAP), provided they meet the relevant criteria. Those who intend to apply for a parental order following a surrogacy arrangement, and who reasonably expect this to be granted, may also be entitled to adoption leave and SAP, as long as the child will live with them. Employees may further choose to convert part of their adoption leave into shared parental leave, which allows parents greater flexibility in how they share time away from work.

Certain adoption routes do not qualify for adoption leave or SAP. These include non-agency adoptions, adopting a family member or stepchild, and becoming a special guardian or kinship guardian. Although employees in these circumstances may not be eligible for statutory adoption entitlements, they remain protected from unfair treatment or dismissal that is connected to their adoption plans or caregiving responsibilities.

Employers must ensure that their policies outline clear procedures for notification, documentation, and evidence requirements. Early conversations and careful planning help manage workloads within the practice and provide employees with clarity and reassurance at what will often be a significant moment in their lives.
