Dental practices have different ways of contracting with hygienists and therapists. Some are employed, and some are self-employed.

How hygienists and therapists are engaged has important legal, financial, and operational implications for a dental practice. The most appropriate arrangement will depend on the practice’s structure and how services are delivered day to day.

While each option can be appropriate in different circumstances, you should ensure that the model you use aligns with what actually happens in your practice. The risks when contracting hygienists and therapists

Hygienists and therapists are often engaged on a self-employed basis. Whilst many of them are genuinely self-employed, it is important that the contract reflects the true nature of the relationship.

Dental practices can face significant liabilities if HMRC or an employment tribunal decide that a hygienist or therapist engaged on a self-employed basis is actually an employee. Those liabilities cannot be passed onto the hygienist or therapist. Understanding the available options and seeking advice at the outset helps to prevent this situation and supports informed decision-making.
